Anyone who fails to meet the court requirements of their probation is considered to be in violation of probation. In Illinois, if you are charged with being in violation of probation or in violation of the terms of your conditional discharge, the State or prosecution can file a petition to revoke probation—or what is referred to in the legal system as a “Motion to Revoke Probation”.
Just because the prosecution files a petition to revoke probation does not mean you will automatically go to jail. You, as the defendant, have the right to deny any charges by the prosecution that you were in violation of your probation. However, the courts will not take lightly to someone who is deemed to be in violation of a probation sentence, and all the State needs is enough evidence at the hearing to convict you. You will not go to trial for this.
The best possible chance you have of winning a case where the prosecution believes you violated the terms of your probation is to be represented by an experienced criminal defense attorney.
